Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Elimar Reyes ("Explori," "we," "us") governing your use of the Explori mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who may use Explori
You must be at least 18 years old (or the age of majority where you live) to use the App. Explori is intended for parents and caregivers, not for use by children.
2. What Explori is
Explori suggests age-appropriate, screen-free activities, calming features, and music to help parents engage developmentally with their babies and toddlers. The App provides general educational and informational content only.
3. Not medical, health, or professional advice
The activities, tips, and developmental information in Explori are for general informational purposes only and are not medical, health, psychological, or professional advice. They are not a substitute for the judgment of a pediatrician or qualified professional. Every child is different; you are solely responsible for deciding whether any activity is safe and appropriate for your child, and for supervising your child at all times. Never leave a child unattended during an activity. If you have concerns about your child's health or development, consult a qualified professional. You use the activities at your own risk.
4. Safety and supervision
You are responsible for providing a safe environment, for selecting age- and ability-appropriate activities and materials, and for supervising your child. Some activities reference toys or small objects; you are responsible for ensuring anything you use is safe and free of choking or other hazards for your child's age.
5. Your account
You can use the App without an account. If you create one, you are responsible for keeping your credentials secure and for activity under your account. Notify us at hello@getexplori.app of any unauthorized use.
6. Purchases and subscription
The App is free to use with ads. You may subscribe to Explori Plus, an auto-renewing subscription that removes ads from the App, billed either yearly (approximately US$9.95 per year) or monthly (approximately US$1.95 per month). The price shown in Google Play at the time of purchase governs, and local prices and taxes may vary.
Renewal: your subscription renews automatically at the end of each billing period (year or month, per the plan you chose) unless you cancel at least 24 hours before the period ends. Cancellation: you can cancel anytime in your Google Play subscription settings; when you cancel, you keep Explori Plus until the end of the period you already paid for, and you are not charged again. Uninstalling the App does not cancel the subscription. Refunds, where applicable, are handled under Google Play's refund policies. Payment is processed by Google Play and the subscription is tied to your Google account; it can be restored on devices signed in to that account. If the subscription price changes, Google Play will notify you in advance and, where required, ask for your consent before the new price applies.
7. Acceptable use
You agree not to: reverse-engineer, copy, resell, or redistribute the App or its content except as allowed by law; use the App unlawfully; attempt to disrupt or gain unauthorized access to our systems; or remove or obscure any proprietary notices.
8. Intellectual property
The App and its content — text, activity descriptions, design, graphics, characters and mascot, and software — are owned by Elimar Reyes or its licensors and are protected by intellectual-property laws. Music in the App is licensed from third parties (e.g. under the Pixabay Content License) and remains the property of its respective owners. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial, personal use. You receive no right to redistribute or repurpose the content.
9. Affiliate links
Some activities include links to toys or materials on Amazon. As an Amazon Associate, Elimar Reyes earns from qualifying purchases. These links are provided for convenience; we do not sell these products, and your purchases on Amazon are subject to Amazon's terms. A recommendation is not a guarantee of suitability or safety for your child — see Sections 3 and 4.
10. Third-party services
The App relies on third-party services (including Google AdMob, Google Play, RevenueCat, and Amazon). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services or content.
11. Disclaimers
THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that its content is complete or accurate.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIMAR REYES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP OR FROM ANY ACTIVITY UNDERTAKEN BASED ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OR, IF YOU PAID NOTHING, USD $0). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Elimar Reyes from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another.
14. Changes to the App and these Terms
We may modify or discontinue the App or features at any time. We may update these Terms; the updated version takes effect when posted with a new "Last updated" date. Continued use after changes means you accept them.
15. Governing law
These Terms are governed by the laws of the Republic of Colombia, without regard to its conflict-of-laws rules.
